These terms are a contract between you and Girard Media, the operator of Tailwin. Creating an account, buying anything, or using the service means you accept them. If you use Tailwin for an organization, you confirm you can bind that organization.
Tailwin measures how AI engines and search engines see a business, tracks crawler and visitor activity on sites where you install our tools, helps produce and publish content, and gives agencies a white-labeled surface for running client work. Features vary by plan and are described at the point of purchase.
You are responsible for your credentials and for what happens under your account, including seats you invite and client sub-accounts you provision. Keep your contact email current; it is how we reach you about billing and material changes.
You may only connect domains and install our embedded tools (crawler tracker, visitor pixel, scan widget, concierge widget) on sites you own or are authorized to operate. For those sites you are the data controller: you are responsible for your own privacy notice, for any consent your jurisdiction requires, and, if you enable person-level visitor identification, for having a lawful basis to use it. That feature is off until you explicitly turn it on.
Scores, grades, and estimated-impact figures are arithmetic over our published rubric, computed from what we could actually measure at the time. Reports state their own coverage: a section we could not measure says so rather than showing an invented number. AI engines change their answers constantly. We warrant honest measurement; we do not warrant, and you should not expect, any particular ranking, mention, citation, traffic, or revenue outcome.
Drafts and reports the product generates for you are yours to use. Review generated content before you publish it; you are responsible for what you publish. We do not claim ownership of your sites, your data, or content generated for you.
If a workspace owner or admin opts in (the setting is off by default), that workspace’s measurements may be included in anonymized, aggregated industry benchmarks. Aggregates never identify a business and are computed only across groups large enough that no contributor can be singled out, as described in the privacy policy. Opting out stops future inclusion immediately and does not affect the rest of the service.
We can suspend accounts that break these rules, and will tell you why.
The service is provided as is. To the maximum extent the law allows, our total liability for any claim arising from the service is limited to the amounts you paid us in the twelve months before the claim, and neither party is liable for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.
You can delete your account at any time; that deletes your data as described in the privacy policy. We can terminate for material breach after notice, or immediately for abuse.
We may update these terms; material changes are announced to account holders by email before they take effect, and continued use after that is acceptance. Disputes are governed by the law of the jurisdiction where Girard Media is organized. Questions: sgirard@girardmedia.com.
